Terms and conditions

1. Agreement

These terms and conditions (“Terms”) apply when you create an account, start a trial, or use the 90-Ten online hub and related member tools at 90-ten.co.uk (the “Service”).

By creating an account or using the Service, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Service.

2. Who we are

The Service is operated as part of the 90-Ten programme. Contact: info@90-ten.co.uk.

The web application is built and maintained under Webwight (technical development and hosting support). Programme coaching and membership operations are delivered by 90-Ten and, where assigned, your advisor.

Marketing information about plans may also appear on related sites such as 90tenprogram.co.uk. Account creation and the member app run on 90-ten.co.uk.

3. What the Service is

90-Ten is a structured coaching and habit programme focused on food habits and movement, with an online hub that may include (depending on your tier and what is enabled for your account):

  • Account, profile, and membership management
  • Daily logging (e.g. steps, mood, water, calories, sleep, weight)
  • Weekly check-ins and feedback (including AI-assisted feedback where available)
  • Challenges, routes, postcards / scrapbook features
  • Food lookup or food logging tools (where enabled)
  • Progress photos and body measurements (when requested or submitted)
  • Messaging and video-call requests with an advisor (where your tier includes them)
  • Tokens or similar in-app allowances used for certain features

The Service is a coaching and education tool. It is not a medical service, NHS service, diagnosis, or emergency care.

4. Eligibility and your account

  • You must be at least 16 years old to create an account.
  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your password confidential and for activity under your account.
  • One person should use one account; do not share login details.
  • Tell us promptly if you think your account has been misused.

5. Free trial

New sign-ups may receive a 28-day trial of membership features for the tier linked to their sign-up (for example, the free Foundation trial page is locked to Foundation / Tier 1).

  • No payment is taken on the free trial sign-up page itself.
  • During the trial you can use the Service according to your tier’s features.
  • When the trial ends, you may be asked to upgrade (continue as a member) or decline.
  • If you decline, we may keep your account for a short grace period (currently 14 days) so you can change your mind. After that, the account and associated data may be deleted as described in our Privacy policy.

6. Membership tiers and features

Plans (for example Track, Foundation, Momentum, Elite) include different levels of support, tools, and allowances. Feature lists on the brochure site or in-app descriptions are a guide; the features available to you depend on your current tier and what is enabled for your account.

We may change, add, or remove features as the programme develops. Where a change is significant, we will try to communicate it reasonably (for example in-app or by email).

7. Fees and payment

Paid membership prices are described on our programme materials and brochure pages (for example the choose-your-tier page on 90tenprogram.co.uk). Payment arrangements may be handled offline or with the gym / programme team until online card billing is fully in place.

If you continue after a trial, you agree to pay the fees for your chosen plan under the payment process we operate at that time. If you do not complete payment or upgrade where required, access may be limited or the account may enter the decline / deletion process described above.

8. Advisors and coaching

Depending on your tier and assignment, you may be supported by an advisor or by the 90-Ten team. Advisors can see information needed to support you (such as check-ins, logs, and progress tools). Availability and response times vary and are not guaranteed to be instant.

Coaching is educational and motivational. It is not a substitute for advice from a doctor, dietitian, or other regulated health professional. Do not use the Service for emergencies — contact emergency services or appropriate healthcare services if needed.

9. Health and results disclaimer

The programme involves food habits, movement, body composition, and related lifestyle topics. Results vary between people. We do not guarantee specific weight loss, health outcomes, or timelines.

You are responsible for deciding whether the programme is suitable for you. If you have a medical condition, take medication, are pregnant, or have concerns about diet or exercise, speak to a suitably qualified professional before or while using the Service.

Stop and seek professional advice if you experience concerning symptoms related to diet, exercise, or weight change.

10. AI features

Some features use automated or AI-assisted tools (for example check-in feedback or food nutrition estimates). These are aids only. Outputs can be incomplete or incorrect. You should review suggestions carefully and not treat them as medical or definitive nutritional advice.

11. Your content and acceptable use

You may upload or enter content such as logs, messages, photos, and measurements. You confirm that:

  • You have the right to provide that content
  • It is not unlawful, abusive, or harmful to others
  • Progress photos and similar content are appropriate and only of you (or with proper permission)

You must not:

  • Try to break, scrape, or overload the Service
  • Impersonate others or create accounts for people without authority
  • Use the Service for anything illegal or to harass others
  • Attempt to access other members’ data without authorisation

You grant 90-Ten a licence to host, process, and display your content as needed to provide the Service (including to your advisor and programme operators). See the Privacy policy for how personal data is handled.

12. Intellectual property

The Service, branding, programme materials, software, and related content (excluding your personal logs and uploads) are owned by 90-Ten or its licensors. You may use the Service for your personal programme participation only. You may not copy, resell, or reverse engineer the Service except as allowed by law.

13. Availability and changes

We aim to keep the Service available, but we do not guarantee uninterrupted access. Maintenance, updates, hosting issues, or third-party outages may affect availability.

We may update the Service, features, tiers, and these Terms from time to time. Continued use after changes are posted may mean you accept the updated Terms. For significant changes we will try to give reasonable notice where practical.

14. Suspension and ending the Service

We may suspend or end access if:

  • You breach these Terms
  • We need to protect the Service, other members, or security
  • Your trial ends and you decline or do not continue membership
  • We are required to do so by law

You may stop using the Service at any time. Trial decline and deletion are handled as described in section 5 and the Privacy policy.

15. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under English law (including death or personal injury caused by negligence, or fraud).

To the fullest extent permitted by law, we are not liable for:

  • Indirect or consequential loss
  • Loss of profits, data, or opportunity (except where we cannot exclude this by law)
  • Outcomes that depend on your personal circumstances, adherence, or third-party services
  • Decisions you make based on AI or coaching content without professional medical advice

Where we are liable and the law allows a limit, our total liability for any claim arising from the Service in any 12-month period is limited to the greater of (a) the fees you paid us for the Service in that period, or (b) £100 if you were on a free trial and paid no fees.

16. Developer access (Webwight)

Technical staff under Webwight may access systems as needed for security updates, bug fixes, hosting maintenance, and improvements, as described in the Privacy policy. That access is for operating and improving the Service, not for unrelated use of your information.

18. Governing law

These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also have rights to bring claims in your local courts where the law requires.
